Inclusive Classroom Challenge 

Contest Period: Contest entrants can enter to win a SMART Accessibility Bundle in the SMART Breaking Barriers Contest (the "Contest") that begins on May 8, 2024, 10:45 am GMT and ends on June 7, 2024, 11:59 pm GMT (the "Contest Period"). The Contest is sponsored by SMART Technologies ULC (the “Sponsor”). Each participant in the Contest will be referred to herein as an “Entrant” or “you”.

Eligibility: The contest is only open to individuals who (i) have reached the age of majority in their state of residence at the time of entry; (ii) are legal residents of the United States (including Washington, D.C., but excluding New York, Rhode Island, and Florida) or Canada; (iii) are physically residing in the United States or Canada; and (iv) are currently employed as an educator or education administrative professional. Verification of individual Entrant’s eligibility may be required at the time of submission or if selected as a winner. This Contest is void where prohibited or restricted by law. All federal, state, and local laws and regulations regarding the eligibility of participants apply.  This Contest is only open to natural persons and the following are ineligible: corporations, businesses, non-profit organizations, governmental agencies, or other entities.

Employees, contractors, representatives, or agents (and those with whom such persons are domiciled, whether related or not) of the Marketing and Sales departments of the Sponsor, its dealerships, resellers, advertising/promotion agencies (collectively, the “Contest Parties”), and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) are not eligible to participate.

Agreement to Rules: By participating in this Contest, you agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”). By participating, the Entrant agrees to be bound to the decisions of the Sponsor (and its authorized representatives), which are final and binding in all matters. By submitting an Entry (defined below), the Entrant agrees to be contacted by Sponsor with Contest-related communications.

How to Enter: No purchase necessary to enter or win.

To enter the Contest, follow the instructions available at https://go.smarttech.com/inclusivitychallenge24 to submit a 5-minute video of your inclusivity initiative(s) along with any supporting materials that showcase its impact (the “Entry”).  You must also agree to the terms and conditions of these Official Rules & Regulations “Entry” to enter the Contest. Video submissions must not be longer than five (5) minutes. Any video submissions longer than five (5) minutes will not be considered for purposes of this Contest.

All Entrants are responsible for ensuring that they have received all required approvals from their school or place of employment to participate in the Contest, to be awarded a prize to be gifted to the school or place of employment, and to cite the school district name, if applicable. Entries will not be considered if they: (a) violate or infringe on another’s rights in any way; (b) they contain any images, videos, or other likeness of minors; or (c) contain sexually explicit, nude, obscene or other objectionable or inappropriate content.

All eligible Entries received during the Contest Period will be entered into the Contest. No other form of Entry into the Contest will be permitted.

Limit one (1) Entry; multiple Entries will not be accepted.

The event may be subject to cancellation or rescheduling and the Sponsor is not liable for the inability of any person to participate in the Contest due to any such cancellation or schedule change.


The Prize and Approximate Retail Value: There will be one (1) prize available to be won consisting of One (1) Accessibility bundle (SMART Board 75" RX, Stamps, Height adjustable stand, Lumio + Spark License for 3 years) having an estimated MSRP of $4750 USD. The prize must be accepted as awarded with no substitutions except by the Sponsor in its sole discretion. The prize is not transferable or redeemable for cash. If the prize is not available, for whatever reason, the Contest Sponsor reserves the right to substitute one of equal or greater value. The prize will only be awarded to the person whose full name and valid email address appear on the official Contest entry form and is a practicing educator or education administrative professional. The Prize will be delivered to and installed at the winner's place of employment.  The Contest Sponsor will not be responsible for the deinstallation or relocation of the Prize for any reason whatsoever.

The prize is awarded “as is” without any express or implied warranty or guarantee from Sponsor, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Only the prize as described herein are available to be awarded; in no event will the Contest Parties be responsible for awarding more or different prizes than stated herein. Any difference between the actual value and ARV of the prize will not be awarded as cash, or otherwise unless otherwise stated.

Winner Selection: After the Contest Period has ended, the Sponsor will select a panel of Sponsor’s employees as neutral judges (“Judges”). The top Entry will be selected by the Judges based on [four] categories of [equal] weight for a total of [one hundred (100)] points: 

(i)    Creativity of Entry;
(ii)    Alignment of Entry with Sponsor’s brand; 
(iii)    Impact (i.e., memorable, stands out with a “wow” factor); and
(iv)    Entertainment (i.e., enthusiasm, energy or humor).  

The winner selected will be the Entry with the highest point total. In the event of a tie, the tied Entry with the highest score for the [Creativity] component will be deemed the winner. In the event that the entries are still tied, the tied Entry with the highest score for the [Alignment of Entry] component will be deemed the winner. The winner selection date will be approximately 9pm GMT one (1) week following the end of the Contest Period.  The odds of winning depend on the number of eligible Entries received in accordance with these Rules during the Contest Period.

Before being declared the confirmed Prize winner, the selected Entrant will be required to supply proof of age and residency by providing a photocopy of one (1) piece of government issued photo identification and sign and return within ten (10) business days of notification the Sponsor's declaration and release form which (among other things) (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize, as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. A more extensive interview will also be requested by the Sponsor for advertisement purposes. If the selected Entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to award the prize to the Entrant that received the next highest score  from among the remaining eligible Entries received in accordance with these Rules during the Contest Period (in which case the foregoing provisions of this section shall apply to such new selected Entrant).

Release: By entering, Entrant agrees to accept and abide by these Rules and agrees that any dispute with regard to the conduct of this Contest, rule interpretation, or award of the prize shall be submitted to Sponsor, whose decision shall be binding and final. By participating, Entrant agrees to release and hold harmless Contest Parties, distributors, and promotional and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents, and representatives of any of the above organizations from any injury, loss, or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance of the prize, participation in any Contest-related activity, or participation in the Contest.

General Conditions: All Entries become the property of the Sponsor, and the Entrant agrees that the Sponsor shall have sole and exclusive rights to use the Entry materials in any marketing, publication, or other forum. The Sponsor assumes no responsibility for lost, delayed, incomplete, incompatible or misdirected Entries. All Entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means or do not conform to or satisfy the conditions set forth in these Contest Rules may be disqualified by the Sponsor. This Contest is subject to all applicable federal, state and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.

By participating in the Contest, you grant (and agree to confirm that grant in writing, if necessary) Sponsor or Sponsor’s authorized representatives the right to use your name, biographical information, likeness, image, voice, and statements for promotion, trade, commercial, and publicity purposes, at any time or times, in all media now known or hereafter discovered, including television, internet and social media, worldwide, without notice, review or approval and without additional notice, compensation or consent except where prohibited by law.  Submission of content to be posted online constitutes permission for same.

The Contest Parties will not be liable for any technical malfunction or other problems relating to telephone networks or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Contest Parties for any reason.

All Entries are subject to verification. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of valid Entries in this Contest will be the Contest server(s).
The Sponsor reserves the right to withdraw or amend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy unless the entrant otherwise agrees. The entrant agrees to creation of a case study using photography and videography after the prize has been awarded.

DISPUTES/CHOICE OF LAW: EXCEPT WHERE PROHIBITED, EACH ENTRANT AGREES THAT: (1) ANY AND ALL AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY STATE OR FEDERAL COURTS SITUATED IN DELAWARE, WASHINGTON (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS’ FEES, (3) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, MAY BE AWARDED (COLLECTIVELY, “SPECIAL DAMAGES”), AND (4) ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES AND ALL RIGHTS TO SUCH DAMAGES MULTIPLIED OR INCREASED. WASHINGTON LAW, WITHOUT REFERENCE TO CHOICE OF LAW RULES, GOVERNS THE CONTEST AND ALL ASPECTS RELATED THERETO.DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE.

Severability: The invalidity, illegality, or unenforceability of any provision of these Rules shall in no way affect the validity, legality, or enforceability of any other provision hereof. Any invalid, illegal, or unenforceable provision shall be deemed severed from these Rules and the balance of these Rules shall be construed and enforced as if these Rules did not contain such invalid, illegal, or unenforceable provision.

Winners’ List: To obtain name of the winner, send an email to [info@smartec] within thirty (30) days of the end of the Contest Period.  The email should contain the following phrase in the “subject” field: “SMART Breaking Barriers” Contest.

Language Discrepancy: In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: The Contest entry form, website, point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.
